A Northern California man was pulled over for driving erratically and a breathalyzer showed that he had 0.0% alcohol level – but he still went to jail and he’s still being charged with DUI…
Newser.com says that the man was pulled over last year in Solano County while driving home from work. After being pulled over, a breathalyzer showed a 0.00% alcohol level on the scene but he was still arrested for DUI. His blood was tested at the jail, twice, and it was “negative for all sorts of drugs. The only positive result: caffeine.”
The article says that a forensic toxicologist says that he has never “heard of anyone being charged with DUI for caffeine in his 41 years on the job.”
The case is about to go to trial and the man who is being charged hopes that the whole thing gets thrown out.
BTW- The DA reportedly says that the charges against the man aren’t based on him having caffeine in his system but “has offered no other evidence.”
